What is “Mediation” in regards to Los Angeles Car accident Cases?

Victims of Los Angeles car accident cases often ask our experienced LA car accident lawyers, “what is mediation?” In short a Mediation is an alternative to going to trial to resolve a legal dispute. Unlike trial, mediations are informal negotiations that are arranged to reach a settlement agreement between the Plaintiff and Defendant. Mediations are led by a neutral third party, called a mediator. Mediators are often retired lawyers, judges or professionals who have experience hearing disputes. In a mediation, both the Plaintiff and the Defendant will present evidence to the mediator regarding the car accident. After all evidence is presented, the mediator will attempt to engage both the Plaintiff and the Defendant to discuss and reach a settlement agreement. The mediator will try to resolve any disputes that come up, with the intent of encouraging a resolution to the matter.

Mediation, much like trial does not occur that often with Los Angeles car accident cases. Instead, car accident cases in LA are usually settled before or after a law suit has been filed. However, if settlement negotiations between the parties has not proved to be productive, mediation is a good way of facilitating the goal of reaching a settlement arrangement. If a law suit has been filed, your case will incrementally be presented to a judge before going to trial, so that the judge can see how settlement negotiations are going, and how the case is progressing. If the judge believes that the parties have been unable to reach a settlement agreement, the judge will often order the parties to go to mediation in order to resolve the dispute before going to trial.

There are many advantages to car accident mediation. For example, unlike trial it is a confidential proceeding that is not open to the public; mediation is not as unpredictable as going to trial because there is no jury involved; if mediation does not help in resolving your case, you can still go to trial; and once an agreement has been reached in a mediation, the case is over.
