What is “service of process” in relation to my Los Angeles Car accident Case?

Under the law in Los Angeles, California, service of process is a requirement that must be followed when filing a lawsuit against an at-fault driver in a car accident. Service of process is essentially the correct and formal way that the at-fault driver finds out that he/she is being sued. When an at-fault driver is served with process, the driver is given two main documents. The first document is called the “complaint.” A complaint is typically written by a Los Angeles car accident attorney. A complaint states the facts of how the accident occurred, the reasons why the at-fault driver is being sued, and what the car accident victim wants from the at-fault driver. The second document is called a “court summons.” A court summons tells the at-fault driver that he/she is being sued, and commands the at-fault driver to appear before the court on a specific date. Once the at-fault driver has been served with process, he/she has 30 days to respond.

In Los Angeles, the at-fault driver must literally be handed the complaint and court summons for service of process to be proper. There are four different ways of properly serving the at-fault driver:
- Asking a Marshall or Sheriff to serve the at-fault driver.
- Using a licensed process server to serve the at-fault driver.
- By asking the court clerk to send the at-fault driver the summons and complaint via certified mail.
- By substituted service. Under certain limited circumstances, you may be able to serve another person instead of the at-fault driver with the summons and complaint. There are special regulations governing substituted service.
